Supreme Court Adopts Permanent Amendments to Oregon Rules of Appellate Procedure

The Oregon Supreme Court and Court of Appeals have adopted permanent amendments to the Oregon Rules of Appellate Procedure (ORAP). The amendments will become effective on January 1, 2015. The rules that have been amended, added, or deleted are:
Rules amended: 1.15, 1.35, 2.05, 2.15, 3.05, 3.07, 3.15, 3.25, 3.33, 3.35, 3.40, 5.05, 5.10, 5.70, 5.80, 5.85, 5.95, 6.05, 6.10, 6.25, 7.05, 7.10, 7.55, 8.05, 8.15, 8.20, 8.50, 8.52, 9.05, 9.10, 9.17, 9.20, 9.25, 10.15, 10.25, 11.05, 11.10, 11.15, 11.20, 11.30, 11.32, 11.34, 11.35, 12.05, 12.07, 12.08; 12.09, 12.20, 12.25, 13.05, 13.10, 16.03, 16.05, 16.10, 16.15, 16.20, 16.25, 16.30, 16.40, 16.50; Appendix 2.05, 3.30, 3.33-1, 7.10-1.
New rules added: 1.32; Appendix 3.33-2, 3.35, 16.50.
Rules deleted: 16.35, 16.60.

Mandatory eFiling Coming to a Court Near You!

Oregon Supreme Court Chief Justice Thomas A. Balmer has approved a plan for a mandatory eFiling requirement for attorneys filing cases in Oregon's circuit and appellate courts. The Oregon Judicial Department will circulate proposed court rules in the upcoming months for comment. The plan calls for a mandatory date of December 1, 2014 for the eleven circuit courts that currently have the eFiling component of the Oregon eCourt system, and includes a transition plan for those courts implementing the system later.

Mandatory eFiling for attorneys filing in the Court of Appeals and Supreme Court is expected to begin in the spring of 2015, following an amendment to the Oregon Rules of Appellate Procedure. Mandatory eFiling for the Oregon Tax Court will be assessed at a later date.

2014 Appellate Almanac: Submissions Requested

As chair of the Appellate Practice Section, I invite section members to contribute to the 2014 Appellate Almanac.  The section is looking for articles, stories, or interesting data on the Oregon appellate courts or Oregon-related cases in the federal appellate courts.  Academic articles, profiles, funny stories, or the real reason digital clocks mysteriously appeared on the podiums overnight are all welcome additions to this year’s almanac.

If you are interested in contributing this year, please contact me directly.  If you need some inspiration from authors past, prior almanacs are available on the section’s website and provide myriad examples of submissions suitable for publication.  I hope to hear from you!

What Just Happened? A Review of Significant 2013 Appellate Decisions

The OSB Appellate Practice Section presents a brown bag CLE on Thursday, February 13, 2014, from noon-1:30 p.m., at Tonkon Torp LLP, 888 SW Fifth Avenue, 16th Floor, Portland Oregon 97204 .

This panel on important 2013 appellate decisions will feature Oregon Supreme Court Justice Rives Kistler, Court of Appeals Judge Rebecca Duncan, Oregon Solicitor General Anna Joyce, and Willamette Law Professor Jeff Dobbins. The speakers will identify and discuss key decisions covering a range of topics.

Supreme Court Building Turns 100!

February 14, 2014 marks the 100th anniversary of the historic Oregon Supreme Court Building.  In honor of the occasion, the court will have a brief program in the third floor courtroom at 3:00 p.m., followed by a reception in the lobby and tours of the courthouse.  I hope members of the section will be able to participate. Feel free to invite your colleagues, friends... and valentines!

A Note from the Chair

Eight years ago, the Appellate Practice Section’s Executive Committee published the first Oregon Appellate Almanac.  Then-Chair, Keith Garza, crafted a 323-page tome filled with wisdom and insight collected from Oregon’s most renowned appellate practitioners and judges.  Well, times have changed…

But hopefully not too much!  This year, the Executive Committee seeks to transform the Oregon Appellate Almanac into an online publication.  Like its six predecessors, Volume 7 of the almanac will serve appellate lawyers and judges by retaining key elements, such as case law summaries, court calendars, statistics, profiles, and articles that improve the practice of appellate law in Oregon.  The new format will foster efficient access to that valuable information.  The section will notify section members when new articles are published, and members can access the articles on the section’s website as soon as they become available.

On behalf of the Executive Committee, I hope that Oregon’s valued appellate practitioners and judges find the new format useful.  I also hope that the format will encourage section members to submit articles for this and future almanacs.  Thank you for bearing with us as we make this important transition.  And have an “Appealing” New Year!
